Quok.it Privacy Policy

This Privacy Policy describes how Quok, Inc. ("Quok.it," "Quok," "we," or "us") collects, uses, and discloses information, and what choices you have with respect to the information.

1. Scope of this Privacy Policy

This Privacy Policy applies to Quok.it's GPU benchmarking, monitoring, and testing services (collectively, the "Services"), quok.it and other Quok websites (collectively, the "Websites"), and other interactions you may have with Quok. If you do not agree with the terms, do not access or use the Services, Websites, or any other aspect of Quok's business.

This Privacy Policy does not apply to any third-party applications or software that integrate with the Services, or any other third-party products, services, or businesses.

2. Information Quok Collects and Receives

Quok may collect and receive the following information:

  • Account information. To create or update a Quok account, you supply us with an email address, password, and organization details. Customers that purchase paid Services provide billing details such as credit card information or billing address.
  • GPU and system data. When you use our Services, we collect GPU identifiers (UUIDs), hardware specifications, driver versions, operating system information, and system configuration data.
  • Performance data. We collect GPU benchmarking results, performance metrics, telemetry data, health check results, and diagnostic information generated through our Services.
  • Usage information. When you interact with our Services, we collect metadata about how you use them, including features accessed, pages viewed, and session duration.
  • Log data. Our servers automatically collect information including IP address, browser type and settings, date and time of access, and cookie data.
  • Device information. We collect information about devices accessing the Services, including device type, operating system, and unique device identifiers.
  • Cookie information. We use cookies and similar technologies to help collect information. You can manage cookie preferences through your browser settings.
  • Third-party data. We may receive data from partners or others that helps us improve our information, such as which IP addresses correspond to certain regions.

3. How Quok Uses Information

Quok uses information in furtherance of our legitimate interests in operating our Services, Websites, and business:

  • To provide, update, maintain, and protect our Services, Websites, and business. This includes using information to support delivery of the Services, prevent or address service errors, security or technical issues, and analyze usage and trends.
  • As required by applicable law, legal process, or regulation.
  • To communicate with you by responding to your requests, comments, and questions.
  • To develop and provide additional features. We use aggregated and anonymized data to develop new Services or improve existing ones.
  • To send emails and other communications. We may send you service, technical, and administrative messages. We may also send promotional communications, which you can opt out of.
  • For billing, account management, and other administrative matters.
  • To investigate and help prevent security issues and abuse.

If information is aggregated or de-identified so it is no longer reasonably associated with an identified person, we may use it for any business purpose.

4. Data Retention

Quok retains information for as long as necessary for the purposes described in this Privacy Policy. This may include keeping information for the period needed to pursue legitimate business interests, conduct audits, comply with legal obligations, resolve disputes, and enforce our agreements.

  • We retain account data while your account is active and for 30 days following deletion.
  • We retain benchmark and performance data for the duration of your subscription plus 90 days.
  • We retain usage logs for 12 months.
  • We retain payment records for 7 years as required by financial regulations.

5. How Quok Shares and Discloses Information

  • Service providers and partners. We may engage third parties as service providers to process information and support our business. These include cloud infrastructure providers, payment processors, and analytics services.
  • During a change to Quok's business. If Quok engages in a merger, acquisition, bankruptcy, dissolution, or similar transaction, information may be shared or transferred, subject to appropriate confidentiality arrangements.
  • Aggregated or de-identified data. We may disclose aggregated or de-identified information for any purpose.
  • To comply with laws. If required by law enforcement or government agency, we may disclose information as legally required.
  • To enforce our rights, prevent fraud, and for safety. To protect the rights, property, or safety of Quok or third parties, including enforcing contracts or policies.
  • With consent. We may share information when you have provided consent to do so.

6. Security

Security is critical to Quok's mission. We use industry-standard technical and organizational measures to protect information from loss, misuse, and unauthorized access or disclosure. These steps take into account the sensitivity of the information we collect, process, and store, and the current state of technology.

Given the nature of communications and information processing technology, we cannot guarantee that information will be absolutely safe from intrusion during transmission or while stored on our systems.

7. Age Limitations

Quok does not allow use of our Services and Websites by anyone younger than 18 years old. If we learn that anyone younger than 18 has provided personal data, we will take steps to delete such information.

8. Changes to This Privacy Policy

We may change this Privacy Policy from time to time. Laws, regulations, and industry standards evolve, which may make those changes necessary, or we may make changes to our services or business. We will post the changes to this page and encourage you to review our Privacy Policy to stay informed. If we make changes that materially alter your privacy rights, we will provide additional notice, such as via email or through the Services.

9. International Data Transfers

Quok may transfer your personal data to countries other than the one in which you live, including to the United States. We deploy appropriate safeguards when transferring personal data from jurisdictions with differing data protection laws, including Standard Contractual Clauses where applicable.

10. Your Rights

Individuals in certain jurisdictions have statutory rights in relation to their personal data. Subject to any exemptions provided by law, you may have the right to request access to your information, as well as to seek to update, delete, or correct this information.

California residents: Under the CCPA, you have the right to know what personal information is collected, request deletion, and opt-out of the sale of personal information. We do not sell personal information.

European residents: Under the GDPR, you have rights including access, rectification, erasure, restriction of processing, data portability, and the right to lodge a complaint with a supervisory authority.
